Right to withdraw unilaterally from the contract

1. Who has this right

The right of unilateral withdrawal belongs to the consumer — a natural person who buys outside their trade, business, craft or profession.

The right does not apply to business buyers(companies, sole traders and other persons who buy in the course of their activity, including a purchase with the company’s OIB on the invoice). For them, the return of goods is possible only with our prior consent.

2. The withdrawal period

The period is 14 days and starts running on the day the goods were handed into the possession of you, or of a person designated by you who is not the carrier.

• If the order was delivered in several consignments, the period runs from the day the last consignment was received.
• The period is met if the declaration of withdrawal is sent before the 14 days expire — it does not have to reach us by then.

3. How to give the declaration of withdrawal

You can give the declaration by any unequivocal statement that clearly expresses that you are withdrawing from the contract. You can:

• send it by e-mail to [email protected];
• fill in and send the form set out below on this page.

Use of the form is not obligatory, but it helps us process the request faster. We will confirm receipt of the declaration of withdrawal without delay.

4. Form for unilateral withdrawal from the contract

Fill in and send this form only if you wish to withdraw from the contract. You can print it and send it by post, or copy it into an e-mail.

You enter the account number only if you want the refund to go to an account other than the one the payment was made from. With card payments the refund normally goes back to the same card automatically.

5. Returning the goods and the cost of return

You must return the goods to us without delay, and no later than 14 days from the day you sent us the declaration of withdrawal.

The direct cost of returning the goods is borne by the consumer.

Important warning for bulky goods: sheet metal, sandwich panels, gutters, structures and similar products cannot be sent as an ordinary postal consignment because of their length and weight, so the cost of return is substantial. Transporting such goods requires a special vehicle, and depending on the quantity and the distance the cost may be comparable to the cost of the original delivery or higher than it. Contact us before sending so that we can agree together on the most favourable way of returning them.

6. Refund of the amount paid

We refund everything you have paid, including the cost of delivery, no later than 14 days from receipt of your declaration of withdrawal.

• We make the refund using the same means of payment that you used, unless you have expressly agreed to another means. You bear no additional costs because of the refund.
• We may withhold the refund until the goods have been returned to us or until you provide us with proof that you have sent them, whichever occurs first.
• If you chose a method of delivery more expensive than our standard one, we are not obliged to reimburse the difference above the standard cost of delivery.

7. Liability for the diminished value of the goods

You may inspect and try the goods in the way you would do in a shop. You are liable for any diminution in the value of the goods that results from handling the goods beyond what was necessary to establish their nature, characteristics and functioning.

With construction products this means that goods that have been installed, cut, drilled, bent or permanently bonded with film no longer have their full value. We deduct the diminution in value from the refund amount, with reasons given.

8. Goods excluded from the right of unilateral withdrawal

Under the Consumer Protection Act, there is no right of unilateral withdrawal for goods made to the consumer’s specification or clearly personalised for the consumer. In our case these are in particular:

• flashings and sheet-metal fittings made to the measurements supplied,
• sheet metal and panels cut or bent to the requested length or shape,
• roof packages configured according to the data on the buyer’s building,
• steel structures and prefabricated halls made to the design or the request of an individual buyer,
• goods ordered in a colour or finish that is not part of our standard range.

Before you confirm an order for such goods we will warn you that the right of withdrawal does not apply to them. This does not affect your rights in the case of a material defect — if the goods are faulty or do not correspond to the specification, the rules on the Complaints and objections page apply.
